Inventory and rental deposit: the right reflexes, from move-in to move-out

Two documents decide how a tenancy ends: the check-in inventory and the check-out inventory. Well prepared, they let you get your deposit back without any dispute.
At move-in: a precise record
The check-in inventory is mandatory. It is drawn up jointly, in your presence or that of your representative, and its cost is shared between tenant and landlord. It is done before you move in or during the first month of occupation.
Take the time to read it. A defect not mentioned at move-in may be attributed to you at move-out. If you discover a problem after signing, report it in writing within the first few days, with photos.
The rental deposit
The deposit covers any amounts owed to the landlord at the end of the lease: damage, unpaid rent or charges. It is held in a blocked account in your name, and the interest is yours.
In Brussels, for leases concluded since November 2024, it may not exceed two months' rent excluding charges, whatever its form. It does not replace rent: the last months remain payable as usual.
During the tenancy
Keep the boiler service certificates and invoices for small repairs. Report problems as soon as they appear: water damage dealt with early costs everyone less. Any alteration to the home, even significant drilling, requires the landlord's prior consent.
At move-out: handing the home back calmly
- Empty the home completely, cellars and attics included.
- Clean thoroughly, including windows, appliances and bathrooms.
- Neatly fill small fixing holes, unless your lease forbids it.
- Have the boiler serviced if this year's service is due.
- Gather all keys, fobs and remote controls.
The check-out inventory compares the home with its description at move-in. Normal wear and tear and ageing are never your responsibility. Read the meters on the same day, with both parties present.
Release of the deposit
The bank releases the deposit on the written agreement of both parties, or by decision of the justice of the peace. When the inventory shows no damage and accounts are settled, your manager helps you obtain the landlord's agreement quickly. If there is damage, you receive a costing before any deduction.
These rules apply in the Brussels-Capital Region. In Wallonia, the deposit can reach three months' rent when it takes the form of a bank guarantee.
